ORAL JUDGMENT

(PER: HON'BLE THE CHIEF JUSTICE MR. JUSTICE N. V. ANJARIA)

While disposing of the writ petition by order dated 25.10.2023, learned Single Judge directed respondent Nos.1 and 2 to consider the representation of the petitioner dated 22.12.2020 and 04.02.2022 and pass appropriate orders in accordance with law. It was observed that it would be open for respondent Nos.1 and 2 to consult respondent No.4 regarding fixation of entry pay of the petitioner having regard to the fact that service of the petitioner was regularised and it was not a case of fresh appointment.

Before the learned Single Judge, the prayer of petitioner was

to restore two increments of the petitioner by fixing his pay in pay band of Rs.9,300/- to Rs.34,800/-.

In response of the present contempt petition filed alleging non-compliance of the aforesaid directions, respondent Nos.1 and 2 have filed their Memo of Compliance dated 09.01.2025 along with which order/endorsement dated 05.02.2024 is produced in which it is stated that the increment cannot be restored to the petitioner.

The aforesaid endorsement marks compliance of the directions of learned Single Judge. Nothing survives in the present contempt petition.

The contempt petition is disposed of as not entertained.

It is observed that if the learned party in person has any grievance about the merits of the endorsement, it is open to the petitioner-party in person to institute appropriate independent legal proceedings, in accordance with law, in respect of which this Court does not express any opinion on merits.
