ORAL JUDGMENT

(PER: HON'BLE THE CHIEF JUSTICE MR. JUSTICE N. V. ANJARIA)

The directions of learned Single Judge which are brought

under the contempt jurisdiction in paragraph 12 of the order dated

13.02.2024, reading as under,

"12. Taking note of the registered instrument, respondent-BBMP cannot re-open the question of title and reject the application for katha on the ground of doubt in title. Subject to the above observation, the endorsement at Annexure-M is set aside and the application for change of Katha to be taken note of and appropriate orders to be passed within four weeks form the date of receipt of certified copy of this order. It is made clear that respondent BBMP while reconsidering the application for katha cannot raise objection on grounds that have been dealt with in the present proceedings."

It is the grievance raised on behalf of the complainant by

learned advocate Mr. B.S. Radhananda that e-khata is not issued,

though directed by learned Single Judge.

Responding to the above submission, learned advocate

Mr. B.S. Karthikeyan for respondent Nos.2 and 3 stated that the

process of issuing e-khata is in progress and that, e-khata to the complainant shall be issued within eight weeks from today.

Relying on the said statement, the contempt proceedings are dropped at this stage. If the order is not complied with, the respondents concerned shall be exposed to aggravated form of contempt.

With the above observations, the contempt petition is disposed of.
