This contempt petition is filed alleging willful disobedience

of order dated 13.06.2022 passed by this Court in W.P. No.14773/2021 (LB-RES). By the said order, this Court directed the accused herein to consider the representation of the complainant and take suitable steps in the matter.

The grievance of the complainant was that two

persons by name Padma N. Devadiga and Nagesh Devadiga have encroached road lying in Sy. No.162/5 of Kergal village, Byndoor Taluk, Udupi District. The compliance report of respondent No.3 shows that after conducting survey of the land, endorsement is issued stating that there is no encroachment. Thus, order is complied. The reason for delay in compliance is explained in the affidavit.

Under the circumstances, reserving liberty to the complainant to seek available remedy against the endorsement of the accused, this proceeding against the accused is dropped.
