This writ petition is filed by petitioner – husband seeking mandamus to direct the V Additional Principal Family Judge, Bangalore to dispose of the pending M.C.No.5846/2017 expeditiously by fixing the time limit.

The husband has filed M.C.No.5846/2017 seeking divorce. It is the case of the husband that the respondent – wife is not cooperating with the trial and when the Court below is closed the evidence, they have approached the Hon’ble Apex Court and obtained an order on 19.01.2023 whereby the Court had reopen the case. It is submitted that thereafter also there is no much progress in the case and after several adjournments, now the matter is going to be listed on 31.05.2024. It is submitted that the petition filed in the year 2017, even after 7 years also the proceedings have not come to a finality. He submits that there shall be a direction to the Court below to dispose of the matter expeditiously.

respondent as no adverse orders are passed by this Court without going into any of the allegations, that are levelled is disposing of this writ petition considering the fact that the M.C.No.5846 is filed in the year 2017 by the husband which is 7 years old now.

Hence, the writ is disposed of directing the Court below to dispose of the case as expeditiously as possible without granting unnecessary adjournments within a period of six month form the date of receipt of the certified copy of this order.
