of land, which earlier belonged to him by way of the registered Sale Deed dated 05.05.2023 as the said property is abutting the property of one Susheelamma. The said Susheelamma is none other than the mother of defendant No.1 and the motherin-law of defendant No.2. Now the whole issue and the dispute between the parties with regard to their respective ownership are not in dispute, but who is interfering with whose possession is a dispute that has to be decided by the Court. Now both of them have their own respective documents with regard to their possession. In a case of this nature, the Court cannot say that by filing such documents, the plaintiff has established the prima facie title because the trial Court observed that there are disputed questions of facts and law and at this stage, the plaintiff has made out a prima facie case i.e., the finding of the Court below cannot be sustained by this Court. In this particular kind of disputed facts, the Court ought to have been more careful as it will unnecessarily give rise to further litigation between the parties. Right from 2021, there is a stay order granted on the I.A. granting injunction. The suit is of the year 2015. At this stage, this Court is not inclined to vacate the stay granted by this Court.
