THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECTING THE RESPONDENTS TO RELEASE THE AMOUNT AS PER THE ORDER DATED 07.02.2019, PASSED BY THE DEPUTY COMMISSIONER CUM ARBITRATOR (NH-13) OF CHITRADURGA PROCEEDING NO.ARB/NH-13/CR.67/2015.16 PRODUCED AS ANNEXURE-B AND ETC.

Petitioners grievance is as to non-payment of compensation and other payables for the subject land acquired. Learned counsel appearing for the answering respondents submits that after his client received the notice, some payments have been made i.e., Rs.7,02,646/- by way of RTGS on 22.10.2023. He further submits that to verify what is paid is in full satisfaction of the claim, the respondents have to furnish all material particulars such as the extent of land taken, how the compensation has been determined. What solatium & interest on the amount payable are paid so that the petitioner can work out his grievance in accordance with law by structuring his case on that basis. There is force in the above innocuous submission and therefore, the

answering respondents have to furnish full particulars to the petitioner within a period of four weeks, from the date a fresh representation is made by him in this regard.

With the above observation, this writ petition is disposed off . If compliance of what is directed above

does not happen, heavy cost may be levied on the concerned officials and that will personally payable from their pocket on a memo being moved before this Court.

It is open to solicit any information/documents from the side of the petitioner for due consideration of his grievance. However, in the guise of such solicitation, no delay shall be brooked.
