The captioned writ petition is filed by the

Company registered under the Companies Act. Feeling aggrieved by rejection of tender application submitted by the petitioner on the ground that the petitioner is a blacklisted/debarred bidder.

Pending consideration of the captioned writ petition, learned Standing Counsel appearing for respondents, however, has brought to the notice of this Court that bids having opened, the petitioner is found to be an unsuccessful bidder. Therefore, in view of the statement made by the learned counsel appearing for the respondents, the captioned writ petition does not survive for consideration.

At this juncture, learned Senior Counsel appearing for the petitioner, would, however, bring to the notice of this Court that since High Court of Calcutta has granted interim order, rejection of the application by the respondents would be stigmatic and impediment in a future tender participation. If the petitioner has a benefit of the interim order, there shall be no impediment to disclose grant of interim order granted by the High Court of Calcutta in future tenders by the respondents – KPCL.
