general manager on contract basis, he applied and was selected on 21.10.2014. He was paid a consolidated salary of Rs.75,000/- per month. The period of contract was two years from the date of his appointment. As per Clause 5 of the contract, the service of the petitioner was terminable by issuing a three month prior notice or by paying three months salary in lieu of notice. The petitioner contends that the respondent No.2 issued a show cause notice on 28.10.2015, alleging that due to stoppage of work in the distillery of the company between 01.06.2015 and 19.10.2015, it had suffered a loss of Rs.2,42,31,600/-. The petitioner was therefore called upon to show cause why the said amount should not be recovered from him. The petitioner denied the allegation and submitted an explanation stating that, since the equipments in the distillery work are worn out and many problems dogged operations in the plant which affected the production. He contended that the loss suffered was not Rs.2,42,31,600/-, but was sum of Rs.13,972/- per day. The petitioner also brought the problems in the distillery to the notice of respondent No.2. Nonetheless, no steps were taken by it to rectify the defects.
