The petitioner, who is working as Scientist-I with the Karnataka Veterinary Animal And Fisheries Science University [ the first respondent ], has filed this petition calling in question the selection of the third and fourth respondents as Assistant Professors with the Department of Veterinary Pathology, and for his appointment as Assistant Professor with the aforesaid Department ahead of these respondents.

Sri V R Sarathy, the learned counsel for the petitioner, is categorical that the petitioner does not intend to pursue his challenge of the third and fourth respondent's appointment as Assistant Professors with the aforesaid Department, and because the petitioner is also absorbed as an Assistant Professor with the same Department, he will not seek for directions on his appointment. In fact, Sri. C. Shashikantha, the learned counsel for the third and

fourth respondents, who has placed on record a copy of the Order dated 10.02.2024 and certain other orders in favour of the third and fourth respondents, submits that the petition could be disposed of because of the turn of events while also stating that the third and fourth respondents concede that the petitioner is senior to them.

The learned counsel for the first respondent is heard in the light of these turn of events and the petitioner's grievance that the seniority list has not been published in the last twelve years and promotions have been held up. The dispute inter se parties are settled, and if there are no legitimate difficulties to publish the Seniority list, the first respondent must publish such list so that further promotions are not delayed. This Court, in the circumstances emphasized and for the reason as aforesaid, is of the considered opinion that the petition must be disposed of directing the first

respondent to publish seniority list as is required in law expeditiously and if for any reason, draft of such seniority list cannot be published before 31.12.2024, to communicate the reasons therefor both to the petitioner and the third and fourth respondents.
