statement denying the contentions taken in the plaint and also asserting that the plaintiffs are not having any right over the property. Consequently, the plaintiffs filed IA No. VIII under Order VI Rule 17 of CPC seeking amendment of the plaint and also the prayer. In the proposed amendment, the plaintiffs are denying the execution of sale deed dated 26.04.1980 receiving of consideration as contended by the defendants. Moreover, the plaintiffs want to delete prayer(a) made in the original plaint and in its place, they wanted to seek declaration that the plaintiffs are the absolute owners of the suit schedule property and the sale deed dated 26.04.1980 is null and void and it is not binding on the right of the plaintiffs. The proposed amendment discloses that the plaintiffs want to change the entire nature of the suit, which was originally a suit for redemption of mortgage in to a suit for declaration of title and also to declare that the sale deed is not binding on the plaintiffs. The original prayer made in the plaint was required to be deleted by substituting altogether a different prayer. The cause of action for such prayer is also entirely different. Under such circumstances, the plaintiffs are not entitled for the relief as claimed in IA No. VIII.
