The petitioner's son viz., Mohammed Jabeer Ahmed, (CTP.No.12542 ) has been convicted for the offence punishable under Section 302 IPC and sentenced to undergo life imprisonment, and as of today, he is in judicial custody for more than 10 years.

Petitioner is seeking to release her son citing ill-health, and the son is required to take care of her and also to provide her with treatment. The petitioner has not been released on parole on earlier occasion, and he is required to take care of his mother has established a prima facie case to release him on parole. I pass the following;

ORDER

i. Accordingly, petition is allowed.

¶25

ii. Respondent No.2 to release the petitioner's son viz., Mohammed Jabeer Ahmed, CTP.No.12542 on parole for a period of 45 days. Respondent No.2 to impose such stringent conditions as are normally imposed to ensure the return of the petitioner to the jail.

iii. The petitioner shall not be involved in any criminal activities during parole.
