ORAL ORDER
The petitioner has challenged an order dated 30.08.2024, passed by respondent No.1, suspending him from service pending an enquiry. He has also sought for a direction to restore the service benefits along with arrears of pay and other allowances.
No.5/2024, for an offence punishable under Section 7(A) of the Prevention of Corruption Act, 1988 (henceforth referred as 'the PC Act, 1988'). The petitioner was arrested and later released on bail after 30 days. The respondent No.1 placed the petitioner under suspension under Rule 10(2)(A) of the Karnataka Civil Service (Classification, Control and Appeal) Rules, 1957 (henceforth referred as 'KCS (CCA) Rules, 1957'). On 30.08.2024, the petitioner was transferred as Community Affairs Office at CMC, Challakere. In the meanwhile, the petitioner filed a Criminal Petition No.8776/2024 on 21.08.2024, challenging his prosecution in crime No.5/2024 and this Court, in terms of an order dated 20.09.2024, stayed the filling of the charge sheet without leave of the Court and not to take any coercive measures against the petitioner. The petitioner then filed a representation before respondent No.1 and requested not to take any disciplinary action against him and permit him to serve as CMC, Harihara, but respondent No.1 did not take any action. Therefore, the petitioner is before this Court challenging the order of suspension and sought for consequential relief to restore his service.
