The petitioner's husband, who is convicted of offences punishable under Sections 302 and 120B read with Section 34 of the IPC and sentenced to life imprisonment, is before this Court seeking a direction for his release on parole.

The petitioner contends that her husband has been in judicial custody for over 13 years and, on a previous occasion when he was released on parole, he did not violate any of the conditions of parole.

Heard the learned counsel for the petitioner and the learned HCGP for the respondent-State.

¶24

In the present case, the petitioner seeks the release of her husband on parole, stating that his presence is required to restore the house where his family members are residing. Given that the petitioner’s husband did not violate any conditions during his previous parole, he is entitled to be considered for release on parole.. Accordingly, I pass the following;

I. Writ Petition is allowed .

II. Respondent No.2 is hereby directed to release petitioner's husband namely Rajashekhar Reddy, (CTP-7716) on parole for a period of 90 days from the date of release.

III. Respondents shall stipulate strict conditions as are usually stipulated to ensure the return of the detenue to the jail and
