The captioned petition is filed assailing the penalty of withholding of five increments without cumulative effect.

The learned Senior Counsel appearing for the petitioner has raised a crucial contention regarding the penalty imposed by the Disciplinary Authority thereby withholding five increments without cumulative effect. The learned Senior Counsel asserts that no clear period for withholding of increments is specified, as required under Rule 51(1) of the Karnataka Civil Services Rules (for short “KCSRs”). However, learned counsel for respondent/Management has presented a counter argument suggesting that petitioner opted for further studies for a duration of three years resulting in withholding of only two increments.

Rule 51(1) of the KCSRs explicitly

stipulates that when imposing penalties such as withholding of increments, the disciplinary authority must provide clear and unambiguous details regarding the period for which the penalty is applicable. On perusal of Rule 51 of KCSRs, this Court would find that this requirement serves multiple crucial purposes including ensuring transparency, facilitating effective communication between the disciplinary authority and the affected employee and upholding the principles of natural justice and due process.

Given the conflicting interpretations of

penalty imposed in the present case on hand, it is imperative to uphold the principles of procedural fairness and ensure that petitioner’s right are safeguarded. Rule 51(1) of KCSRs mandates that disciplinary penalties including the withholding of increments must be accompanied by a clear and

specific statement regarding the period for which the penalty is applicable.

Failure of the disciplinary authority to

specify the period for which the petitioner is deprived of increments constitutes significant procedural lapse. Furthermore, it undermines the petitioner’s right to fair treatment and procedural fairness which are fundamental tenets of administrative law and principles of justice. Therefore, it is evident that penalty imposed by the disciplinary authority in its current form does not comply with the procedural requirements outlined in Rule 51(1) of KCSRs. The absence of clear and specific statement regarding the period for which the increments are withheld warrants interference at the hands of this Court.

This Court has also taken cognizance of a fair statement made by the learned Senior Counsel

who has confined his arguments to the infractions indicated in imposing penalty of withholding of five increments without stipulating period.

For the foregoing reasons, this Court proceeds to pass the following:

ORDER

(i) The writ petition is allowed in part.

¶40

(ii) The respondent-Disciplinary authority shall review the penalty imposed on the petitioner and rectify the deficiency by providing a clear and specific statement detailing the period for which the increments are withheld.

(iii) The disciplinary authority must ensure that such communication is issued properly and in compliance of Rule 51 of KCSRs.

(iv) The enquiry shall be conducted by the disciplinary authority with due diligence, impartiality and transparency. The respondents shall be tasked with examining

all relevant documentation including disciplinary records, correspondence and any other pertinent evidence that sheds lights on the enforcement of penalty.
