These writ petitions are filed seeking for following

Prayer in W.P.no.104250/2024:

I. Issue a Writ of Mandamus directing the respondent no.6 authority to consider the representation dated 06.05.2024 vide Annexure-K1 and pass necessary order to consider petitioner as High School Assistant Teacher since his appointment till 2016 and provide the back wages and also provide all consequential benefits from the date of appointment in the interest of justice and equity.

II. Such other writ of order or direction as this Hon’ble Court deems fits on the fact and circumstances of the case in the interest of justice and equity.

In prayer W.P.no.104245/2024:

I. Issue a Writ of Mandamus directing the respondent no.6 authority to consider the representation dated 02-05-2024 vide Annexure-K2 and pass necessary order to consider petitioner as High School Assistant Teacher since her appointment till 2016 and provide the back wages and also provide all consequential benefits from the date of appointment in the interest of justice and equity.

Sri Manoj N.Bikkannavar, learned counsel for petitioners submitted that petitioners have been working as High School Assistant Teachers from date of their appointment in year 2005. But in order of promotion issued in year 2016, they were shown as promoted as High School Assistant Teachers, in which post they were working from inception. It was submitted, until then, petitioners were being paid salary equal to that of a primary school teachers. Therefore, they were entitled for difference in pay.

Expressing their grievances, petitioners submitted representations as per Annexure-K1 in W.P.no.104250/2024 and Annexure-K2 in W.P.no.104245/2024. Though same is acknowledged received and reasonable time has lapsed, same have remained without consideration. Therefore, seeks for allowing petitions by directing respondents to consider petitioners’ representations.

Somannavar, learned counsel for respondent no.6 submitted that in case, petitioners’ representations are pending, same would be considered in accordance with law within a reasonable time.

In view of submission, since from writ petition record, submission of representations by petitioners and their pendency with respondent no.6 is not in dispute, it would be appropriate to dispose of writ petitions by directing respondent no.6 to consider representations within one month from date of receipt of certified copy of this order.

Needless to state that result of consideration shall be informed to petitioners and respondents shall consider specific grievance of petitioners that they were appointed High School Teachers from inception.

Writ petitions stand disposed of accordingly.
