JUDGMENT

In this appeal, a memo for disposal dated 07/11/2023 has

been filed by the Advocate for appellant to state that, a settlement has been entered into between the appellant and Respondent No.3 namely Sri. Krishna Reddy N.R. on 21.10.2023. The memo for disposal also encloses the copy of the settlement dated 21.10.2023.

As per the terms of the settlement, Respondent No.3 has been paid an amount of Rs.9,75,000/- (Rupees Nine Lakhs Seventy Five Thousand only) in full and final settlement of all claims against the Employer (appellant). He shall not have any other claim whatsoever either monetary or otherwise against the appellant. The memo for disposal also encloses the receipt for the amount of Rs.9,75,000/- by way of Cheque No.410678 dated 21.10.2023 drawn on State Bank of India, (03024)-SME Peenya Industrial Estate Branch, B-96, 2^nd Cross, Peenya Industrial Estate, 1^st Stage, Bengaluru- 560 058. The memo for disposal also encloses a photo copy of the aforesaid cheque for Rs.9,75,000/-.

Sri. Mukkannappa, learned counsel appearing for Respondent No.3 acknowledges that the memo of settlement dated 21.10.2023 has been entered between the appellant and Respondent No.3-Sri. Krishna Reddy N.R.

Mr. Somashekar, the learned Counsel for the appellant and Sri. Mukkannappa, learned counsel for Respondent No.3 submit that, in view of the Memo for Disposal filed by the appellant enclosing therewith the Settlement dated 21.10.2023 binding appellant and Respondent No.3, the writ appeal be disposed of. It is ordered accordingly.
