purchased the property towards the Eastern side of his property and he is in possession of the purchased property, however, defendant seriously disputed the measurement of the suit property. According to the defendant the plaintiff purchased the property measuring 41x31 1/2 feet and he is in possession and the plaintiff is claiming an excess extent by filing the present suit. Ex.P-4 is the sale deed in favour of the plaintiff. PW1 deposed that suit property was measuring 45 x 65 ft. purchased by one Neelakantaradhya, subsequently, in O.S.No.144/1986 filed by Renukaradhya and a compromise was entered and southern portion of the suit property was allotted to B.R.Puttasomaradhya and northern half portion was allotted to B.R.Renukaradhya, Puttasomaradhya sold to the plaintiff and the plaintiff is the absolute owner, to the south of the suit property, defendant has purchased 41 x 15 ft., the dispute revolves around the 3ft. which according to the plaintiff, the defendant has protracted his roof to an extent of 1 ½ x 41 ft. to the northern side and constructed supporting wall to the earlier existing mud wall measuring ½ x 41 ft. in half triangular
