Petitioners are before this Court seeking to review

the order dated 03.11.2022 passed in

W.P.No.17541/2021.

2. Petitioners file a memo that the order would be

implemented in the following manner.

The memo reads as follows:

"The undersigned counsel appearing for the petitioner in the above case most respectfully submits that, pursuant to the calling for the Second Tender on 09.08.2021. The indent Number of First Tender would automatically deleted. In view of the said position without having the indent Number of the First Tender, the work order cannot be given to the Respondent herein. That being so the undersigned most respectfully prays this Hon'ble Court to kindly Direct the Project Director of the e-procurement Cell to permet the petitioner to Issue work order to the Respondent herein to the indent Number of the First Tender (Indent No.32311) or in the alternate direct the Project Director of the e- procurement Cell, there by enables the petitioners herein to Issue work order in the name of the Respondent here in the Interest of justice and equity. "

Learned counsel for the petitioners would

hasten to add that there is a communication between the Managing Director to the Project Director, e-Procurement Cell, expressing his inability to implement the order.

In the light of the memo so filed, the said

inability would not in any way cause any impediment in implementation of the order.

Therefore, as accepted by the learned counsel

Sri. K.S.Bheemaiah the respondents are permitted to raise

an indent number and proceed with the implementation of the order.
