JUDGMENT

These appeals and cross objections are arising out of the judgment and award passed in MVC No.567/2012 and 568/2012 on the file of the Prl. Senior Civil Judge and AMACT, Ranebennur dated 30.08.2013.

Facts in brief which are utmost necessary for disposal of the appeals and cross objections are as under:

2.1 Adiveppagouda and Gangamma being wife of deceased Channappa being claimants in MVC No.567/2012 and 568/2012 respectively laid claim in respect of road traffic accident that occurred on 21.05.2012 at about 10 a.m. involving motorcycle bearing No.KA-27/H-5553 and Tata Ace bearing No.KA-17/B-4612.

2.2 In respect of the road traffic accident, a criminal complaint was filed and the same was investigated by investigation agency thoroughly and charge sheet came to be filed against the driver of Tata Ace vehicle.

2.3 Driver did not challenge the charge sheet and said

Tata Ace vehicle was insured with Royal Sundaram Insurance Company Ltd.

2.4 On contest claim petitions were allowed in a sum of Rs.1,18,320/- and 2,23,000/- in respect of claim in MVC No.567/2012 and 568/2012 respectively.

Being aggrieved by the quantum of compensation, insurance company and claimants have preferred the appeals and cross objections.

Sri.G.N.Raichur counsel for insurance company contended that fastening the liability on the insurance company is incorrect and sought for modification of the award.

Per contra, Sri.G.S.Hulumani contended that the quantum of compensation awarded by the tribunal is inadequate and sought for allowing the cross objections by granting appropriate compensation.

In view of the rival contentions of the parties, this

court has perused the material on record meticulously.

On such perusal of the material on record, accidental injuries sustained by the claimant Adiveppagouda and death of Channappa S/o Channabasappa Banakar stands establish by placing necessary evidence.

In the case on hand, accidental injuries by Adiveppagouda and death of Channappa in road traffic accident that occurred on 21.05.2012 involving aforesaid vehicles stands established by placing necessary oral and documentary evidence on record.

Admittedly, there is no proper proof of income furnished by the claimants.

Therefore, tribunal had to assess the income of the injured and the deceased notionally. For the accidental injuries/death for the year 2012, notional income is to be assessed in a sum of Rs.6500/- p.m.

Channappa was aged 70 years as per postmortem report. Therefore, there is no scope for addition of the amount as per the dictum of the Hon’ble Apex Court in the case of National Insurance Company Limited vs. Pranay Sethi and Others reported in AIR 2017 SC 515.

Therefore, quantum of compensation needs to be reassessed by taking proper monthly income and also applying principles of law enunciated in the case of United

India Insurance Company Limited vs. Satinder Kaur alias Satwinder Kaur and Others reported in AIR 2020 SC 3076 and Magma General Insurance Company Limited vs. Nanu Ram and Others reported in 2018 ACJ 2782.

Insofar as claimant Gangamma is concerned, claimant is also entitled for the enhancement of compensation on the other heads.

Accordingly, quantum of compensation is reassessed as under:

Insofar as the argument of the insurance company that the driver did not possess the proper endorsement in

his driving license is concerned, the same is not permissible to be considered by this court in view of the authoritative principles of law enunciated in the case of Hon’ble Apex court in the case of Mukund Dewangan vs. Oriental Insurance Company Limited reported in AIR

i) Appeals by the insurance company in
