Car bearing Reg.No. KA-05-MC-4565 drove the same in rash and negligent manner and dashed to the motorcycle ridden by the claimant, resulting in the road traffic accident. It is contended that the claimant sustained grievous injuries i.e, left proximal tibia fracture and also fracture of shaft of tibia and fibula. He was shifted to Damodhar Manjunath Pai Memorial General Hospital, Harihar, where first aid treatment was provided. Thereafter, he was shifted to Bapuji Hospital, Davanagere. It is further contended that the claimant was inpatient for a period of 3 days in the said hospital and thereafter, he was shifted to Kasturba Hospital, Manipal on 05.05.2017 and he underwent operation for the fractures. It is also contended that he has incurred substantial amount towards the treatment, suffered mental and physical agony. It is pleaded that the claimant was working in K.P.M Birla factory, Harihar and was earning Rs.30,000/- per month and was also doing business and was earning Rs.20,000/- per month. Due to the accident, he has suffered permanent physical disability and not in a position to work as he used to work prior to the accident. He filed claim petition seeking compensation of Rs.20,00,000/- from the respondents.
