there was no revocation of the power of attorney, his father continued to be the power of attorney and in exercise of the power vested under the power of attorney, he became the absolute owner of the suit property and consequently, had conveyed the suit property in favour of the plaintiffs. He further contended that the property purchased by the father of the plaintiffs lay abutting 8th cross road, while the property purchased by the defendant was 35,000 sq.ft. in Sy.No.149 which lay within 7th and 9th cross road, which is evident from the sketch attached to the sale deed executed by the children of A.Gundappa in favour of the defendant. He submitted that in the said sketch, 8th cross, road is conspicuously not shown which gives an impression that the defendant had not purchased any property abutting 8th cross road. He therefore, submits that the property purchased by the plaintiffs, father of the plaintiffs as well as the defendant are different properties and therefore, the question whether the defendant has any semblance of right, title or interest in the suit property is a question of fact which needs to be tried by the Trial Court.
