After addressing the arguments for some time, joint memo is filed sighed by respective Advocates and revision petitioner. Joint memo reads as under:

“The counsel for the petitioner and respondent are agreed to settle the above case amicably for sum of Rs.7,00,000/(seven lakh) as here under as per this Hon’ble Court.

1. The petitioner agreed to pay sum of Rs.7,00,000/out of which he was deposited sum of Rs.3,50,000/- before the Trial Court.

2. The petitioner agreed to pay sum of Rs.3,50,000/(Three Lakh Fifty Thousand) within 3 months from today with 3 instalments.

3. The respondent is agreed to receive the same from the petitioner and the petitioner has no objection to release the deposited amount in favour of the respondent.”

Placing the joint memo on record, revision petition

stands disposed of.

It is made clear that if the amount is not paid as agreed in the joint memo, order of the learned Trial Magistrate confirmed by the First Appellate Court stands restored automatically.
