Learned counsel for the petitioners is absent. No representation even when the matter is passed over twice and again called at 2.58 pm.
The order sheet dated 27.08.2024 reads as under:
" Learned counsel for the petitioners absent. No representation.
The petition is of the year 2021. As per order dated 28.04.2021, notice is ordered to respondent No.2. Till date, process fee is not paid for issuance notice and copy of the petition along with annexures are not furnished. It appears that the petitioners are not interested in prosecuting the petition. However to afford opportunity, list this petition next week."
Inspite of that there is no progress in the matter.
Learned High Court Government Pleader submits that the petitioner has sought for quashing the FIR. Now the investigation is completed and the charge sheet is filed. Learned Magistrate took cognizance of the offence and the matter is now pending in C.C.No.25143/2022.
In view of the above, the criminal petition is dismissed
for non prosecution.
