that in the second week of January 2013 accused approached him for a hand loan of Rs.3,00,000/- to meet his urgent financial and family necessities. Accordingly, in the last week of January 2013 he advanced hand loan of Rs.2,50,000/- to the accused. Accused promised to repay the same within one month. After the stipulated period when accused failed to repay the amount, in the first week of March 2013, complainant Shankarappa demanded accused for repayment. Expressing his inability to repay the amount, accused promised the repayment on or before 14.03.2013 and issued cheque dated 14.03.2013. However, when it was presented for encashment on 14.03.2013, it was returned dishonoured with endorsement "Funds insufficient". When complainant Shankarappa got issued a legal notice, accused sent an evasive reply and hence, the complaint.
