Ex.P12 the postmortem report shows that the victim had infected burns on face, neck, front and sides of chest and abdomen, both upper limbs, front of both thighs and legs, foul smell was emanating from the pus pockets of the wound. There was degloving of the skin over those injuries. He found such injuries after about five days of treatment. Under such condition she being fit to give statement as per Ex.P8 becomes doubtful. Further PW.13 who allegedly certified the fitness of the victim on Ex.P8, in his cross-examination unequivocally admits that before recording the statement of the victim, he had not seen the victim and he was not present when the victim was admitted into the hospital. He says he went near the victim at 9:30 p.m., and at that time duty doctor and nurses were present, but he was not able to name any of them. He says he did not enquire the doctor who was treating the victim about her medical condition. Such admission makes recording of Ex.P8 in the manner alleged doubtful.
