submits that accused No.3 who is similarly placed to that of the appellant – accused No.2 has been granted bail by this Court in Crl.A.No.1196/2023. He further submits that he has not sought for grant of bail to the appellant – accused No.2 on the ground of parity before the Sessions Court. Therefore, he now intends to withdraw the appeal,

with liberty to file a fresh petition before the Sessions Court on the ground of parity and also on other grounds.
