Doddaballapura Rural Police Station, Bengaluru District, for the offences punishable under Sections 302 & 201 of IPC, is before this Court under Section 439 of Cr.P.C, seeking regular bail.

Heard the learned counsel for the parties.

FIR in Crime No.142/2024 was registered by

Doddaballapura Rural Police Station, Bengaluru District, for the aforesaid offences against unknown person, on the basis of first information received from Venkatesh s/o Sriramaiah on 01.05.2024, after the dead body of unknown female aged around 22-25 years was found by him in a isolated place within the jurisdiction of Doddaballupra Rural Police Station, Bengaluru. During the course of investigation of the case the petitioner herein was arrested on 03.05.2024 subsequently remaned to

judicial custody. Investigation in the case is completed and charge sheet has been filed against the petitioner for the aforesaid offences.

The bail application filed by the petitioner in Crl.Misc.No.10127/2024 before the jurisdictional Sessions Court was rejected on 05.09.2024. Therefore, he is before this Court.

Learned counsel for the petitioner having

reiterated grounds urged in the petition, prays to allow the petition.

Per contra, learned HCGP has opposed the bail

petition and he prays to dismiss the petition.

Perusal of the material available on record would go to show that the entire case of the prosecution is based on circumstantial evidence. Marriage of the petitioner with the deceased was solemnized on 14.02.2022 and from the said marriage, the couple have a girl child. Allegation in the charge sheet is that the petitioner had a illicit relationship with a lady known as

Kalpana. Therefore, deceased was quarreling with him and also opposing his relationship with Kalpana. It is in this back ground, the petitioner allegedly had decided to eliminate his wife Veena and on 22.04.2024 he had taken his wife Veena along with him in a two wheeler bearing Reg.No.KA-04-KE-8482 to an isolated place near Jakkalmadagu Dam forest area and had strangulated the neck of the deceased with his hands and had committed her murder. Thereafter he poured petrol on the dead body of deceased Veena, burnt the same and escaped from the spot.

Material on record would go to show that after the deceased was found missing, the petitioner had approached the Bengaluru Women Police on 29.04.2024 and submitted a complaint based on which a missing complaint was registered in Crime No.56/2024. Subsequently the dead body of deceased was found within the jurisdiction of Doddaballapura Rural Police Station on 01.05.2024 and FIR was initially registered against

unknown person. During the course of investigation of the case, the petitioner was interrogated and based on his confession, he has been arrayed as accused in the present case.

Investigation in the case is completed and charge sheet has been filed. The petitioner has a small child to be taken care of by him. Allegation found in the charge sheet against the petitioner who has no other criminal antecedents is required to be proved in a fullpledged trial. Under the circumstances, I am of the opinion that his prayer for grant of regular bail needs to be answered affirmatively.

The petition is allowed .

The petitioner is directed to be enlarged on bail in Crime No.142/2024 registered by Doddaballapura Rural Police Station, Bengaluru District, for the offences punishable under Sections 302 & 201 of IPC, subject to the following conditions:

a) The petitioner shall execute a personal bond for a sum of Rs.2,00,000 (Rupees Two Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court;

b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;

c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;

¶48

d) The petitioner shall not involve in similar offences in future.
