ORDER
Learned counsel for the Petitioner has moved a
memo dated 09.02.2024 which reads as under:
"The undersigned counsel for the petitioner seeks the leave of this Hon'ble Court to withdraw the instant criminal petition filed under Section 482 of the Cr.P.C. praying for quashment of further proceedings in C.C.No.12763/2023 pending on the file of the 42nd A.C.M.M.
The Petitioner seeks liberty to approach the Trial Court to seek discharge as under Section 226 & 227 or 239 & 240 of the Cr.P.C.
WHEREFORE, it is most humbly prayed that this Hon'ble Court be pleased to take the above memo on record and orders may be passed accordingly in the interest of justice."
