The present petition is filed under Section 439 of

Cr.P.C by accused No.1 seeking grant of bail in Crime

No.95/2019 of Dharwad Sub-Urban Police Station pending

in S.C.No.79/2022.

After hearing for some time, a memo came to

be filed. Memo is placed on record, which reads as under:

“Herein the advocate for petitioner beg to submit as under:

That, the petitioner /accused no.1 is ready to pay the bail bond amount of Rs.1,00,000/-, in equal installment within a period of 3 months for his release on bail, in the interest of justice.”

The accused No.1 -petitioner having jumped the bail granted by this Court in Crl.P.No.101279/2020, and remained absent and split up case registered against him in S.C.No.79/2022. Taking note of grant of bail earlier and also having regard to the fact that the petitioner is ready to pay the bond amount in a sum of Rs.1,00,000/- in 03 equal installments, this court is of the considered opinion that the bail request of the petitioner can be allowed by directing him to pay the bond amount in a sum of Rs.1,00,000/- which was a condition imposed to the petitioner while admitting bail on earlier occasion.

Further, the apprehension of the prosecution can be met with by imposing suitable and stringent conditions. Accordingly, this court passes the following:

ORDER

The Criminal Petition is allowed subject to the following conditions:

(1) The petitioner shall pay the bond amount in a sum of Rs.1,00,000/in 03 equal

installments within a period of three months from today.

¶41

(2) The release order of the petitioner shall be issued only after payment of the first installment.

(3) The petitioner shall execute a fresh bond in a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the Trial Court.

(4) The petitioner shall attend the court regularly.

¶44

(5) The petitioner shall not tamper the prosecution witnesses.

Violation of any of the above conditions, would entitle

the prosecution to seek for cancellation of bail.
