Learned counsel for the petitioners files a memo seeking
withdrawal of the petition with liberty to file a fresh petition.
Memo reads thus:
“ Herein the advocate for the petitioner files this memo as under.
It is submitted that the petition does not survive because the IO is filed a charge sheet, the present petition as such they may be permitted to withdraw the same.
Hence the petition may kindly be dismissed as not pressed with liberty to file a fresh petition in the ends of justice and equity.”
In view of the memo, the petition is dismissed as withdrawn with liberty as prayed. As a consequence,
I.A.1/2024 does not survive for consideration.
