Learned counsel for the petitioner after arguing the matter for some time, submits that earlier petition filed by the petitioner/accused No.1 in Crl.P.No.103594/2023 was dismissed as withdrawn as against him on 10.01.2024 with liberty to file a fresh petition, after examination of CWs1, Cw9 to 14 is completed before the Trial Court. Till date, charge is not framed before the Trial Court and that has been causing serious hardship to the petitioner, who is in custody for the last nearly one year. He submits that petitioner’s wife who was pregnant as on the date of petitioner’s arrest has now given birth to a child and there is nobody to look after his wife and newly born child. He submits that the Trial Court be directed to examine Cws1 and 9 to 14 on priority.

Learned HCGP does not oppose the prayer made by learned counsel for the petitioner.
