Learned counsel for the petitioners has filed a memo seeking withdrawal of the petition. Memo reads thus:

“ The advocate for the petitioners respectfully submit as under,

The complainant/respondent No.2 filed complaint against the petitioners in Crime No.121/2021 registered at Gangavathi Town PS for the offence punishable U/s 406, 418 & 420 of IPC, pending on the file learned Prl. Civil Judge & JMFC, Gangavathi, the petitioners preferred the present petition seeking quashing of FIR and complaint in the said crime No.121/2021. However, during the pendency of this petition the Gangavathi Town PS filed charge sheet against the petitioners before trial court and the trial court has taken cognizence and registered case in C.C. 3099/2022. In view of the subsequent development of filing chargesheet by the police authorities, the petitioners are intending to challenge the subsequent action and the criminal proceedings initiated against them.

Hence, it is respectfully prayed that the Hon’ble court may kindly be permitted the petitioners to withdraw the above petition with liberty to file fresh petition to challenge the proceedings initiated in C.C. No.3099/2022, to meet the ends of justice and equity.”
