The wife is before this Court seeking transfer of M.C. No.63/2023 which has been instituted by the husband for restitution of conjugal rights before the Prl. Senior Civil Judge & CJM, Mandya to the I Addl. Prl. Judge, Family Court, Mysuru, where she has filed a petition for divorce in M.C. No.1056/2023 and for maintenance in Crl.Misc. No.293/2023 which are both pending consideration.

In my view, as the wife is already before the Courts at Mysuru seeking divorce and maintenance, it It would be appropriate to withdraw M.C. No.63/2023 from the file of Prl. Senior Civil Judge & CJM, Mandya and transfer the same to I Addl. Prl. Judge, Family Court, Mysuru. This Civil Petition is, accordingly, allowed.

Since the parties are represented by their counsel, they are directed to appear before the I Addl. Prl.
