The wife is before this Court seeking transfer of O.S. No.423/2023 which is instituted by the husband before the III Addl. Prl. Judge, Family Court, Bengaluru to the Family Court, Chikkamagaluru.

The learned counsel appearing for wife contends that it would be impossible for the wife to travel to Bengaluru from Chikkamagaluru and also points out that the wife had initiated proceedings under Section 125 before the Prl. Judge, Family Court, Chikkamagaluru and the husband had also participated in the same.

In my view, it would be appropriate to withdraw O.S. No.423/2023 from the file of III Addl. Prl. Judge, Family Court, Bengaluru and transfer the same to
