Sri.Srinivasa.K., learned counsel for the petitioner, Sri.Shirish Krishna., learned counsel for respondents 1, 2 & 4 and Sri.H.V.Devaraju., learned counsel for respondent No.3 have appeared in person.

The captioned Writ Petition is filed seeking a Writ of Mandamus directing respondent No.1 to consider the case of the petitioner for retrospective absorption as probationary mazdoor from the date of completion of six years of initial service as Gangmen and to extend all the benefits as per the settlement dated:03.06.2004 vide Annexure-B.

Learned counsel for the petitioner and respondents have urged several contentions. Heard, the contentions urged on behalf of the respective parties and perused the Writ papers with utmost care.

Counsel Sri.Shirish Krishna., submits that the petitioner has sought a Mandamus directing the first respondent to consider his grievance but, he has not approached the first respondent. Hence, appropriate order may be passed.

In reply, counsel Sri.Srinivasa.K., submits that Writ Petition may be disposed of directing the petitioner to submit the representation before the first respondent about his grievance.

The Submission made on behalf of respective parties is paled on record.

The petitioner is directed to submit the representation about his grievance before the first respondent within ten days from the date of receipt of the Certified Copy of this Order and if the representation submitted by the petitioner, the first respondent is directed to consider the same and act in accordance with the law. The Writ Petition is disposed of accordingly.
