The respondent - Hanumanthappa entered into Casual/ Daily Wager in the office of the Social Forest Office of the Range Forest Officer, Harihara, from then, he was working as a Daily Wager/ Casual Labourer. He was continued as a worker in the Forestry. However, during the year 1990 i.e., on 01.04.1990, he was terminated from the service as he did not satisfy the service needs of the Department. However, he challenged the termination order by raising a dispute before the Industrial Tribunal, Bengaluru in I.D.No.521/1991. The application came to be allowed on 28.08.1993 with a direction to the Authority to reinstate the applicant with continuation of service and with all benefits with 50% backwages. The respondent made an effort to join the department for work. The same was not considered; consequently, he made an application on 18.05.1996 and sought permission to join the duty. In that circumstances, the application was considered in the year 1999 i.e., on 15.02.1999 and he was re-employed as a Casual Daily Wager and paid the consequential wages.
