The petitioner filed this writ petition seeking for a

Mandamus directing respondent No.2 to issue a provisional Diploma certificate and Marks sheet.

Brief facts leading rise to filing of this petition are as under:

It is the case of the petitioner that the petitioner got admitted for Diploma in Civil Engineering in respondent No.3- college. The petitioner appeared for the examination conducted by the respondent No.2 and respondent No.2 declared the petitioner as pass in 3 years course, but the respondent No.2 has withheld the provisional Diploma certificate and also marks sheet. The petitioner submitted a representation to the respondent No.3, but the petitioner has not submitted a representation to the respondent No.2, as the respondent No.2 is the competent authority to issue Provisional Diploma certificate and marks sheet.

Learned counsel for the petitioner submits that

liberty may be reserved to the petitioner to submit a representation to respondent No.2. Submission is placed on record.

As the petitioner has not submitted a

representation to the respondent No.2. Hence, question of issuing a Mandamus to respondent No.2 would not arise. However, liberty is reserved to the petitioner to submit a representation to respondent No.2. In case if the petitioner submits the representation to respondent No.2, respondent No.2 is directed to consider the representation and issue Diploma certificate and marks sheet to the petitioner within 15 days from the date of receipt of representation. Accordingly, the writ petition is disposed of.
