The learned counsel for the petitioners files a memo. The memo reads as following:

The Petitioner had filed the above Writ Petition challenging the sale notice issued by the Respondent bank dated 22.09.2023 for an e-auction which was to be held on 27.10.2023 between 12 PM to 5 PM but the same is failed, due to no bidders identified and this Hon’ble court be pleased to permit the Petitioner to withdraw the above Writ petition with a

liberty to file a fresh Writ Petition as and when need arises. The Memo may be taken on record in the interest of justice and equity.”
