THIS W.P. IS FILED PRAYING TO-CALL FOR THE RECORDS IN KMC/MISC/NO.03/2018, FROM THE CUSTODY OF THE R-1. QUASH THE IMPUGNED ORDER AT ANNX-A DTD. 06.02.2018 PASSED BY THE R-1 IN REJECTING THE COMPLAINT. QUASH AND EXPUNGING THE REMARKS THAT THE "COMPLAINT IS MADE WITH THE MALAFIDE INTENTION. THE COMPLAINANT HAS PREPARED CONCOCTED STORY AND HAS FILED COMPLAINT TO HARASS THE PRESIDENT OF THE COUNCIL". IN THE IMPUGNED ORDER AT ANNX-A.DIRECT THE R-1 TO INITIATE AN ENQUIRY AGAINST THE R-2 PURSUANT TO THE COMPLAINT OF THE PETITIONER DTD. 12.01.2018 AT ANNX-E.

KMC/Misc/No.03/2018 passed by 1^st respondent at Annexure 'A' in rejecting complaint, this writ petition is filed.

2. After arguing matter for sometime, learned counsel for petitioner submitted that petitioner being an advocate practicing before Karnataka Medical Council (for short, 'KMC'), would suffer prejudice in case observations made in impugned order were to remain on record.

Learned counsel for respondent no.1 fairly submitted that respondent no.1 would not have any objection for expunction of remarks or observations in impugned order against petitioner.

Prima-facie there are no grounds to interfere with impugned order on merits. However, in view of above submission, observations made against petitioner - counsel in impugned order are ordered to be treated as expunged. Rejection of complaint would thus be without any observations against petitioner affecting his right to practice before KMC.

In terms of above, Writ petition is disposed of.
