The petitioner is before this court seeking the following

prayer:

"a. Directing the 2nd Respondent to decide the reference made by the 3rd Respondent dated 22/09/2022 bearing no.DVS.L A W.CR.78/2019/72345/F1 vide Annexure-B

b. Further grant any such other relief that this Hon'ble Court deems fit to grant in the interest of justice and equity".

The petitioner claims to be the Archak of Sri.Sadashiva Mahaganapathi Temple, Surtkal, Mangaluru

It is the claim of the petitioner that his father had worked in the capacity of Archak till he attained the age of 80 years and therefore, a decision has to be taken with regard to the appointment of the Archak and the Trustee. The decision having not been taken on reference, which was made on 22.09.2022 by the third respondent, the petitioner has knocked at the doors of this Court in the subject petition.

Learned AGA would submit that the matter has been deferred on 13.10.2023 and the matter would be taken up and appropriate orders would be passed in accordance with law, if reasonable time is granted.

Therefore, respondent No.2 before whom the reference is made by the third respondent shall conclude the proceedings within four months from the date of the receipt of the copy of the order, if not earlier.

It is made clear that this Court has not considered the merit of the claim of the petitioner.
