Labour Court, Bengaluru by raising a dispute under Section 10(4-A) of the I.D Act in I.D.No.56/2015. The Labour Court issued notice to the Corporation in respect of the dispute raised by the workman. On 08.01.2016, the Appellate Authority allowed the appeal of the workman, directed reinstatement pending initiation of disciplinary proceedings by issue of fresh charge sheet, with a direction to get the application filed for approval withdrawn. The petitioner office issued an order of reinstatement subject to terms and conditions as per the order of the Appellate Authority. He was issued with fresh articles of charge as per the order of the Appellate Authority on 11.02.2016. The respondent submitted his reply to the articles of charge. The Labour Court vide award dated:23.11.2016 rejected the claim petition. However, made certain observation with regard to issue of fresh articles of charge. The Industrial Tribunal disposed of the application filed in SLA No.648/2015 in view of the order passed in I.D.No.56/2015. The award of the Labour Court in so far as it relates to the observation made in paragraph No.6 as regards to fresh articles of charge is called into question in this Writ Petition on several grounds as set-out in the Memorandum of Writ Petition.
