THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA IS FILED PRAYING TO ISSUE WRIT OF MANDAMUS DIRECTING THE RESPONDENTS TO ACT ON THE REPRESENTATION DATED 14/06/2021 IN THE LIGHT OF COMMUNICATION DATED 22/07/2022 AND TO RELEASE THE FUNDS FOR DUE EXECUTION OF SALE DEED WHICH IS PRODUCED AT ANNEXURE-G.

In this writ petition, the petitioners have sought for the following reliefs:

“Issue a Writ in the nature of mandamus or any other appropriate writ directing the respondents to act on the representation dated 14/06/2021 in the light of communication dated 22/07/2022 and to release the funds for due execution of sale deed which is produced at Annexure-G.”

It is the grievances of the petitioners that their representation dated 14.06.2021 at Annexure-G, submitted to the respondents have not been considered so far by them nor any order has been passed on the same. Under these circumstances, the petitioners are before this Court by way of the present petition.

Per contra , learned HCGP for the

respondent Nos.1 to 3 and 5 submits that if reasonable time is given, they would consider and pass necessary order on the said representations.

In view of the aforesaid facts and

No.2-The Deputy Commissioner, Dharwad District, Dharwad is hereby directed to address the grievances of the petitioners and consider their representation dated 14.06.2021 at Annexure-G bearing in mind the communication at Annexure-F dated 22.07.2022 and pass appropriate order in accordance with law, within a period of three months from the date of receipt of a copy of this order.
