In a suit for possession based on title, where the defendant sets up a plea of adverse possession, the burden is on the defendant to prove that plea. The plaintiff is not required to seek a declaration of title if title is clear from the pleadings and evidence. Mere dismissal of an earlier suit for mandatory injunction (which was held to be the wrong remedy) does not create a cloud on the plaintiff's title. The High Court dismissed the second appeal, holding that the concurrent findings of the courts below on title and possession were correct, and that the defendant's contentions regarding benami transaction, limitation, and Section 6 Specific Relief Act were not supported by pleadings or issues in the trial court.
