is suit schedule property which property is given on rent to the defendant and in the said agreement ie., Ex.P28 there is clear recitals to make out that Karnataka Prakruthi Chikitsa Prachara Trust is the sole and absolute owner of the property bearing No.1537/1, 9th Main Road, 3rd Block, Jayanagar, Bangalore. In the cross examination of PW1 there is no suggestion put forward on behalf of the defendant to deny or dispute the title of the laintiff Trust in the suit schedule property. PW1 in his cross examination had stated that BDA had given the roperty to the Trust, and it is by way of lease. PW1 had enied the suggestion that said lease had now been terminated and cancelled. But in order to substantiate he contention of the defendant he had not produced any documents with regard to the cancellation or termination of lease of the plaintiff. Though DW1 in his evidence affidavit had denied that plaintiff is the sole and absolute owner of the property bearing No.1537/1, 9th Main, 3rd Block, Jayanagar, Bangalore, in his cross examination he admits that Ex.P28 is entered between him and the plaintiff. Further there is clear admission by DW1 that Karnataka Prakruthi Chikitsa Prachara Trust is the owner of the suit schedule property and he is the tenant, Hence this evidence further supports the contention of the plaintiff and proves that the suit schedule property belongs to the plaintiff. Further defendant himself admitted that he is a tenant under plaintiff through agreement of lease dtd.1.10.2004 for a period of 9 years. If Ex.P28 is taken into consideration whereby under the terms and conditions of the said document, period of tenancy is 11 months from the date of
