Crime No.192/2022 dated 2.7.2022 and subsequent proceedings in C.C.No.36620/2022 pending on the file of 3rd Additional Chief Metropolitan Magistrate Court, Bengaluru, for the offences punishable under Sections 447, 427, 504, 506 r/w 34 of IPC. The counsel also would vehemently contend that even a suit was filed in O.S.No.298/2023 before the City Civil and Sessions Judge, Bengaluru at CCH-19 and before approaching the Court, no injunction order was granted in the said suit and by withdrawing the said suit as a chance litigant, without discussing the details of earlier suit, filed another suit with the same pleadings in O.S.No.25115/2023 and even the same is also brought to the notice of the Trial Court and Trial Court fails to take note of the fact that respondent No.1 herein has approached the Court with clean hands and while granting an order of temporary injunction, the Court has to exercise the discretion and while exercising the discretion the plaintiff i.e. respondent No.1 has to approach the Court without suppressing any material before the Court.
