further claimed that the land bearing Survey No.1/1 measuring 29 guntas situated at Charaladinne village, Huthuru Hobli, Kolar Taluk was purchased by Chikka Nallappa from late Byrappa and late Kallappa in terms of a sale deed dated 26.05.1969 and another portion of land bearing Survey No.117/2 renumbered as Survey No.117/9 measuring 2-1/2 guntas situated at Doddanahalli village, Huthuru Hobli, Kolar Taluk from late Narayanappa in terms of a sale deed dated 02.07.1969. The plaintiffs claimed that from the date of purchase, Chikka Nallappa was in peaceful possession and enjoyment of the suit schedule properties. He later executed a will on 15.04.1997 dividing the properties amongst his five brothers and his daughter Smt.Puttamma. Plaintiff no.1 purportedly got 'B' schedule properties, plaintiff nos.2 and 3 got 'A' schedule properties, plaintiff nos.4 and 5 got 'C' schedule properties and plaintiff no.6 got 'D' schedule properties. They claimed that after the death of Chikka Nallappa on 17.04.1997, they were in peaceful possession of the properties bequeathed to them. However, the khatha of the suit properties continued in the name of Subbanna and Byrappa, the erstwhile owners of the said land.
