the month of September, 2012, accused approached the complainant to advance loan of Rs.2,00,000/- for his business need. Hence, on 06.09.2012 accused borrowed loan of Rs.2,00,000/- and promised to repay the said amount within six months. After couple of months when the complainant demanded to repay the loan amount accused issued a cheque bearing No.652823 dated 08.03.2013 for Rs.2,00,000/- drawn on the State Bank of India, Koramanagala Branch, Bangalore and on being presentation of said cheque on 08.03.2013 and 28.03.2013, cheque was dishonoured twice with an endorsement as “funds insufficient” vide memo dated 15.03.2013 and 30.03.2013, then the complainant got issued legal notice calling upon the accused to pay the amount due under the cheque. Though notice was duly served on the accused, accused failed to repay the amount, hence the complainant filed private complaint under Section 200 of Cr.P.C., for the offence punishable under Section 138 of N.I.Act.
