the complainant has produced Cash/Credit Bill No.1215 dated 2.1.2012 wherein it shows that accused had purchased 1 cot, 2 tables, 2 BPL 21" TV, 4 chairs, TV Stands worth Rs.1,80,450/- instead of paying hard cash, accused has issued a cheque marked at Ex.P1 for Rs.1,80,450/- drawn on Canara Bank, Puttur Branch. As per the request of the accused, complainant presented the said cheque for encashment but the said cheque was dishonoured for want of sufficient funds in the account of accused. Accordingly, Bank has issued a memo as per Ex.P2. He further submits that, because of dis-honour of the said cheque, he issued legal notice on 14.3.2012. A copy of the said notice is at Ex.P3. The said notice was sent by RPAD vide Ex.P4 and P5 postal receipt and acknowledgement. To this notice, accused has not issued any reply nor made any payment. Therefore, he submits that accused has committed an offence under Sec.138 of NI Act and would submit that both the Courts below have rightly convicted the accused. Therefore, this Court cannot interfere with the judgments of both the Courts.
