her statement she has stated that she was acquainted with the petitioner. On 25.01.2023 he had taken her in his Autorickshaw and thereafter, they had gone to the house of his grand-mother and stayed there for two days. She has also stated that against her wish, petitioner had sex with her in his grandmother's house. The material on record would go to show that the victim girl has voluntarily accompanied the petitioner and also stayed in his grand-mother's house for two days. The allegation against the petitioner is required to be proved in a full fledged trial. The petitioner, who is aged about 25 years and an Autorickshaw driver by profession, who is in custody since 28.01.2023 onwards. Investigation in the case is completed and the charge sheet has been filed. Though the learned counsel appearing for respondent No.2 has stated that the petitioner is a habitual offender, in his statement of objections, he has not referred to any criminal case, which is filed against petitioner. The submission made by the learned counsel for the petitioner that he has no criminal antecedent, has not been opposed by the learned HCGP.
