of the Will dated 25.10.1943 executed by Smt. Nagammanni in favour of their father. The accused as the legal representatives having succeeded to the property which was the subject matter of the Will dated 25.10.1943 seem to have entered into an agreement of sale agreeing to convey the property in favour of the Spire Projects Private Limited. Therefore, the claim of the respondent that the accused have all, in tandem attempted to deprive the respondent of his right, title or interest in the property in question, does not throw up any cause of action for the respondent to invoke process of criminal law by alleging offences under Sections 420, 463, 464, 465, 467, 471, 474 read with Section 120A of IPC. Therefore, the Trial Court could not have taken cognizance of the offence on the mere say of the respondent that the execution of the agreement of sale in favour of the Spire Projects Private Limited did result in offences punishable under Sections 420 or 463, 464, 465, 467, 471, 474 read with Section 120A of IPC and Section 82 of the Registration Act, 1908.
